A = member of the=20 European Union since 2004, Slovenia is today a stable, vibrant democracy = which=20 offers a stimulating and low-risk business environment and represents a = bridge=20 between Balkan, Central European and Western European countries, all of = which it=20 is connected to by historical and cultural ties.
Half the size of=20
Switzerland and with two million inhabitants, Slovenia is situated at =
the=20
crossroads of Central Europe, between the Alps and the Adriatic Sea, =

Austria, Italy, Hungary and Croatia. The majority, almost 85% of the =
country=92s=20
population is Slovenian; two minorities, Hungarians and Italians, have =
the=20
status of indigenous minorities under the Slovenian Constitution. =

predominantly Roman Catholic, although the country also has a small =

Protestants, Orthodox Christians, Muslims and Jews. Slovenian is a =

Slovenia=92s roots=20 of democracy extend deep into history when Slovenians practiced the = unique=20 custom of electing the Dukes of Carinthia for almost 1,000 years, up = until the=20 late 14th century. After the 9th century Slovenians were under foreign = rulers=20 but maintained their language and cultural entity; from the 14th century = until=20 the end of World War I =96 with the exception of 4 years in Napoleon"s = Illyrian=20 Provinces =96 they were part of the Habsburg Monarchy and the = Austro-Hungarian=20 Empire until they established the multinational state of Serbs, Croats = and=20 Slovenians in 1918, renamed the Kingdom of Yugoslavia in 1929. =
After World War=20 II, Slovenia became part of socialist Yugoslavia and its most prosperous = federal=20 republic, experiencing the broad opening of its society in cultural, = civic and=20 economic realms, particularly in the 1970s and 1980s.
On = June 25, 1991=20 Slovenia declared its independence. Historical ties with Western Europe, = a=20 strong economy and a stable democracy have assisted in Slovenia"s = transformation=20 into an advanced, modern and competitive European state.
On May 1, 2004, Slovenia became = a member of=20 the European Union. In the same year, it joined NATO and graduated from = being a=20 World Bank borrower to a donor partner.
On January 1, 2007, Slovenia = became the=20 first new European Union member state to adopt the euro as its national=20 currency.
Slovenia served as the = Chairman-in-Office of=20 the Organisation for Security and Cooperation in Europe (OSCE) in 2005 = and was=20 the Chairman of the International Atomic Energy Agency Board of = Governors in=20 2006-2007.
In the first half of 2008 = Slovenia became=20 the first of the ten 2004 EU new members to hold the EU"s rotating = presidency=20 and held the chairmanship of the Committee of Ministers of the Council = of Europe=20 in 2009.

euro at the beginning of 2007 Slovenia saw a lively economic performance =

very positive economic trends in the following years. Higher economic =

compared to the EU average has allowed Slovenia to gradually catch up in =

In the last period the structure = of the=20 Slovenian economy has changed in favour of an expanding services sector, = while=20 in some manufacturing sectors production has dropped. Concerning the = economic=20 structure, the biggest part in added value is represented by services,=20 accounting for close to 65% of GDP. On the other hand, the still = relatively high=20 GDP rate is attributed to the manufacturing sector, which including = construction=20 accounts for 34%, with the most important being manufacturing at 22%. = The share=20 of agriculture as a source of GDP declined to 2% in 2009.

indicates the ever stronger importance of knowledge-based services. =

such as telecommunications, business, financial and real-estate services =
were=20
the fastest growing services market in the past few years in Slovenia. =
In the=20
manufacturing sector, technology
Slovenia=92s exports of goods = and services=20 account for 65 to 70% of GDP. The country has acquired a reputation as = an open,=20 competitive economy. In line with the favourable international trends = and=20 economic upturn across the EU, Slovenia=92s goods and services exports = increased=20 annually by 12% on average, in real terms in the past few years. The = growth of=20 goods exports alone rose by even more, while growth in services exports = for the=20 major part was a consequence of the buoyant tourism and transport = sectors that=20 respectively accounted for 45% and 30% of total invisible exports. The=20 slowing down = of the=20 European economy especially in Slovenia=92s = main export=20 partners contributed to the export decline in 2008-2009;=20 however, in the first quarter of 2010 year-on-year exports grew = by 7.2%=20 while imports rose by 4.4%.

In the case of the circulation = of goods=20 among EU states, i.e. goods originating from member states or goods that = have=20 gained such a status (community ware), it is no longer necessary to = carry out=20 the following customs formalities: submission of documents for the = customs=20 control of goods, submission of an application for the customs-permitted = consumption or use of goods, the submission of a customs declaration = etc.=20 However, as part of the implementation of tax policy certain = administrative=20 formalities still have to be respected.
The free movement of goods among = EU member=20 states only relates to those goods originating from EU member states and = those=20 with so-called =91community status=92. Community status is granted to = goods=20 completely produced in EU territory or imported from a non-EU member = state and=20 released for free circulation (community goods).

In the importing and exporting = of goods from=20 and to the third countries, the customs regulations of the EU are = applied. The=20 key EU acts regulating this area are:
the Community Customs Code and = related=20 enforcement regulations;
the EEC Regulation on the System = of Customs=20 Preferences; and
the Regulation on Tariffs and = Statistical=20 Nomenclature, and the Regulation on Common Customs Tariff.
The member states are authorised =
to regulate=20
some areas of customs legislation that are not covered by the EU=92s =
customs=20
regulations in their national legislation. For the areas of customs =
regulations=20
not regulated by the EU=92s legislation,
the authorisation to issue permits = for a=20 simplified procedure of proving the origin of goods in customs=20 procedures;
customs control of non-community=20 ware;
the types of customs declarations = for which a=20 non-community ware customs procedure may be required; and
recording, reporting and charging = of customs=20 duty etc.
In foreign trade with Slovenia = the measures=20 and potential restrictions stipulated by the EU law need to be taken = into=20 account with the help of the TARIC (Integrated Tariff of the = European=20 Communities).
The EU=92s successful =
functioning is=20
determined by the equal and consistent application of its customs =
regulations by=20
all of its member states. This consistency is achieved through =
application of
TARIC is both an integrated EU = tariff and a=20 manual containing all the regulations and measures to be applied to the=20 importing and exporting of goods to and from the EU. It is a manual = instructing=20 the customs authorities which regulations are in force; at the same = time, it is=20 an indispensable source of information for importers and = exporters.
In the TARIC, every ware is = assigned a=20 10-digit numerical code which consists of a harmonised system and a = combined=20 nomenclature. For some EU measures, special codes are prescribed (e.g.,=20 anti-dumping, processed food codes, etc.) and that is why in special = cases more=20 than 20-digit code could be applied.

To properly use the TARIC one must know the = correct TARIC=20 classification code of goods and the origin of=20 goods.
Origin of goods
Based on their origin, goods = imported to the=20 EU from third countries (non-community goods) are divided into two = groups, as=20 presented below.
Goods of preferential origin, = for which more=20 favourable customs rates are applied or which are relieved of customs = duties.=20 Preferential origin is granted to those goods which, when purchased or = produced,=20 meet the requirements specified by bilateral or multilateral=20 agreements.
Goods of non-preferential = origin, to which=20 regular customs rates and other measures of the EU=92s trade policy are = applied,=20 e.g. the calculation of compensation or anti-dumping customs rates=20 etc.
For certain countries (non-EU = member states=20 that have signed bilateral or multilateral agreements on the origin of = goods),=20 the EU recognises trade preferences, which may be used if the rules on = the=20 origin of goods are observed. Determining the origin of goods is a = demanding=20 task and the customs bodies may issue binding information on the origin = of these=20 goods on the basis of a request and the fulfilment of related=20 requirements.
Given their type, i.e. its = structure,=20 technical characteristic and the purpose of use, goods are classified in = the=20 customs nomenclature. The EU applies a combined nomenclature that gives = a=20 detailed classification of a globally recognised, harmonised system of=20 nomenclature and tariff denominations. Customs duties, as well as other = measures=20 of trade policy, therefore depend on the classification of goods in the = combined=20 nomenclature. The customs bodies may, in relation to a specific request = and on=20 that basis, as well as on the basis of meeting certain requirements, = issue=20 binding information on the classification of goods in the combined=20 nomenclature.
The basic rule is that the = customs value,=20 verified on the basis of the invoice value submitted to customs bodies, = results=20 from the actual value of the goods purchased in order to be imported = into the=20 country.

Importation of goods into the EU customs territory =
All goods under customs control = that are=20 imported into the EU=92s customs territory must be submitted to a = customs=20 authority so that it may determine their status, i.e. whether it is = community=20 ware or non-community goods.
Goods released for a transit = procedure prior=20 to importation into the EU=92s customs territory are not subject to all = the=20 measures prescribed for the importing of goods to the EU=92s customs = territory.=20
For non-community goods, a = summary=20 declaration must be submitted on a special form so that the customs body = can=20 conduct the customs procedure. If the request is immediately submitted = for the=20 customs-approved treatment or use of goods, the recipient of such goods = or the=20 person who has them at their disposal may request temporary warehousing = for=20 those goods.
Such temporary warehousing may = last for 20=20 days and, with seaborne trade, for 45 days. Upon expiry of the deadline = for=20 temporary warehousing, the person who has temporarily kept the goods = must=20 request the approved treatment or use of goods, i.e. the re-exporting of = the=20 goods, the application for the customs procedure etc.=20
Customs-approved treatment or use of goods
Goods imported into the EU=92s = customs=20 territory and meeting all the prescribed conditions may be assigned at = any=20 moment a customs-approved treatment or use regardless of its type, = quality,=20 origin or purpose. This does not prevent a prohibition or restriction = justified=20 by reasons of public morality, public order, public security, protection = of the=20 health of people, animals and plants, the protection of national wealth, = historical or archaeological value, or the protection of an industrial = or=20 business secret.
For a particular customs =
procedure, a=20
customs declaration, as the most common form for the customs-approved =
treatment=20
or use of goods, must be submitted. The customs declarant submits the =
custom=20
declaration and the goods to the customs body. The customs declarant may =
submit=20
their customs declaration in any EU state where they will be treated=20
equally.
The customs declaration may be =
submitted in=20
writing, in the form of a computer data exchange system, or by an act =
whereby=20
the person holding the goods in their possession expresses their =
readiness to=20
submit those goods to the customs procedure (the conclusive act), if =
such a=20
possibility is envisaged by the EU=92s regulations. =
The customs declaration must = contain all the=20 data needed to conduct the customs procedure and must be accompanied by = all the=20 documents required for the procedure for which the goods are=20 declared.
Since 1 =
January=20
2011 all traders involved in customs transactions and international =
logistics=20
must make an electronic declaration to Customs providing security data =
on goods=20
before these goods are brought into, or out of, the European Union. The =
type of=20
security data requested from traders varies according to the means of =
transport=20
and the reliability of the traders involved in the =
operation.
Import procedures
In import procedures a written =
customs=20
declaration, as the most important form, is submitted in a single =
administrative=20
document (=91SAD=92; Slovenian abbreviation: EUL).=20
Export and transit procedures
In export and transit procedures = an=20 electronic declaration is submitted in the form of a computer data = exchange=20 system (except where the declarant=92s electronic system is not = operational at the=20 time of the declaration).
The export regime is in line =
with the EU=20
rules called ECS/AES (Export Control System/ Automated Export System) =
and the=20
transit regime is in line with the EU rules called NCTS (New =
Computerised=20
Transit System). The goods are accompanied by an export-accompanying =
document=20
(=91EAD=92; Slovenian abbreviation: SIL) in the export procedure, and =
with a=20
transit-accompanying document in transit procedures.=20
Release of goods for free circulation
With the release of goods for = free=20 circulation non-community goods acquires the customs status of community = goods.=20 For the release of goods for free circulation, one of the abovementioned = forms=20 of customs declarations must be submitted to the customs body. Through = the=20 release of goods for free circulation, the trade policy measures are=20 implemented, the formalities envisaged for the importing of goods are = fulfilled=20 and import duties are duly paid.
The so-called suspensive = procedures of=20 non-community goods are: external transit, customs warehousing, inward=20 processing with a deferred system of payment, processing under customs = control=20 and temporary importation.
Customs procedures with an = economic impact=20 are applied to the following procedures: customs warehousing, inward = processing,=20 processing under customs control, temporary importation, and outward = processing.=20
For the application of any of = the suspensive=20 procedures, or of a customs procedure with an economic impact, a = preliminary=20 authorisation must be obtained from the customs authority.=20
External transit
The external transit procedure = enables the=20 circulation of non-community goods from one part of the EU=92s customs = territory=20 to another, without being subject to the payment of import or other = duties or=20 any other measures of trade policy. The external transit procedure is = applied to=20 the export of goods from the EU for which export incentives are paid or = will be=20 paid.
The external transit procedure = is realised=20 with:
a transit-customs declaration = submitted via=20 electronic data exchange;
when this is impossible and in = exceptional=20 cases a written transit declaration (EUL); and
a TIR carnet, ATA carnet and other = such=20 documents.
Goods must be submitted to the = customs=20 authority which controls the shipment and determines the time frame for = transit.=20 Goods must be submitted to the customs authority at the destination = where the=20 transit procedure is completed.
The customs warehousing = procedure=20 enables:
the warehousing of non-community = goods so that=20 import duties or trade policy measures are not applied; and
the warehousing of community goods = in cases=20 where the law regulating the area so envisages.
A customs warehouse is every = place chosen=20 and controlled by the customs bodies where goods may be stored under = certain=20 conditions. The customs warehouse may be public or private. Public = warehouses=20 are those that may be used by any person. Private warehouses are those = whose=20 purpose is to store goods owned by their owners. In the warehousing = procedure=20 goods cannot be processed, finished or upgraded except in cases = permitted by=20 standard procedures and actions permitted by the customs bodies. =
In the customs warehousing = procedure goods=20 may remain there without any time limit. The time limit is only imposed = on=20 certain agricultural products if it is so decided in accordance with the = common=20 agricultural policy.
The inward-processing procedure = in the EU=92s=20 customs territory enables one or more refinement operations of = non-community=20 goods with the intention of re-exporting products or goods produced by=20 refinement from the EU=92s customs territory or released for free = circulation.=20 Import duties envisaged for this type of goods are either repaid or = waived if=20 those goods are exported from the EU=92s customs territory as a new = product.=20
Customs authorities determine = the time frame=20 within which these goods must be exported or re-exported, otherwise = these goods=20 must acquire a new, customs-permitted consumption or use. This time = frame takes=20 into account the time needed for refinement and for the sale of products = obtained through refinement whereby, according to the relevant = regulations, this=20 time frame is unlimited. For the sake of simplification, the customs = bodies may=20 determine the time frame so that it begins from the current month or = quarter and=20 expires on the last day of the next month or quarter.
Products made by refinement must = be=20 exported, released for free circulation in the EU=92s customs territory = or stored=20 at a customs warehouse.
Goods imported for the = inward-processing=20 procedure may be exported for refinement outside the EU=92s customs = territory if=20 so permitted by the customs body in accordance with the requirements = determined=20 in the provisions on outward processing. =
The procedure of processing = under customs=20 control in the EU=92s customs territory enables the use of non-community = goods=20 intended for processing that modifies its nature and state whereby it is = not=20 subject to import duties or trade policy measures. In this procedure, = the=20 products are called =91processed products=92. When import duties are = paid on the=20 basis of a customs rate for processed products, this procedure enables = the=20 release of processed products for free circulation.
The purpose of the processing of = a product=20 under the customs control procedure is for more processed goods to be=20 transformed into less processed goods, e.g. for old machinery to be = demolished=20 and transformed into industrial waste. This procedure is permitted = following the=20 request of the person conducting or organising the processing operation. = The=20 customs authorities may issue their authorisation if:
imported goods can be recognised = in the=20 processed products;
after the processing operation, = goods cannot=20 be economically reassembled or restored to their previous state; = or
the procedure does not cause = irregularities=20 relating to the rules of origin and quality restrictions applying to = imported=20 goods.
Temporary importation
The temporary importation = procedure enables=20 unchanged non-community goods (i.e. the only change occurs due to its = use)=20 intended for re-exportation to be used in the EU=92s customs territory = to be fully=20 or partly relieved of import duties without being the subject of trade = policy=20 measures.
A temporary importation permit = is issued to=20 a person who uses the goods or disposes of them for the use of others. = The=20 customs bodies determine the time frame within which the imported goods = must be=20 exported or re-exported or must obtain a new, customs-approved treatment = or use.=20 This time frame must be long enough to allow for the objective of the = permitted=20 use to be achieved. The longest permitted time frame within which goods = may=20 remain in the temporary importation procedure is 24 months, while the = customs=20 bodies may also determine, in agreement with the party in question, a = shorter=20 time frame. The customs bodies may, at the request of the given party, = prolong=20 the time frame in order to enable the use of goods if it is justified by = extraordinary circumstances.
For goods that do not meet the = requirements=20 of a temporary importation permit with a full exemption from import = duties, the=20 customs body may approve a temporary importation procedure with a = partial=20 exemption from import duties. In such a case, the import duty amounts to = 3% of=20 the duty payable for that type of good if it is released for free = circulation,=20 for each month of the temporary importation. There is a table of goods = for which=20 a temporary importation procedure with a partial exemption from import = duties=20 may not be approved.
The outward-processing procedure = enables=20 community goods to be temporarily exported from the EU=92s customs = territory with=20 the intention of carrying out a refinement operation. Once they return = to the=20 EU=92s customs territory, the products obtained in such operations are = released=20 for free circulation with a full or partial exemption from import = duties. The=20 consequence of the temporary exportation of community goods is the = application=20 of import duties, trade policy measures and other formalities related to = the=20 exporting of goods. Special restrictions are imposed on the use of the=20 outward-processing procedure.
Authorisations are issued to = persons with a=20 seat in the EU if, when bringing back the refined goods into the EU = customs=20 territory, it can be established that the products obtained resulted = from the=20 refinement of temporarily exported goods and that the issuance of a = permit for=20 the outward-processing process was not detrimental to the fundamental = interests=20 of EU producers (economic conditions).
If goods are temporarily = exported for a=20 free-of-charge repair, they will be released for free circulation upon = return=20 with a full exemption from import duties when proof is submitted to the = customs=20 bodies that the repairs were done free-of-charge on the basis of = contractual or=20 legal obligations related to guarantees or a factory error.
If payment is required for = temporarily=20 exported goods, the costs of repair are recognised as their customs = value if=20 they are the only costs incurred by the owner of the permit and if it is = not=20 affected by any type of relationship between the owner and producer of = the=20 goods.
Outward processing allows for = the=20 replacement of exported products with imported spare products. The = customs=20 bodies allow this system of replacement in cases of the repair of = community=20 goods, except for special goods that are subject to the common = agricultural=20 policy.
Exports
The export procedure enables EU = goods to=20 leave EU territory. If non-community goods are exported the regulations = on=20 re-exportation, instead of exportation, are applied. Exporting occurs = after the=20 submission of a customs declaration and the application of other customs = formalities, including trade policy measures. Except for exceptional = cases, the=20 customs declaration shall be submitted to the customs service = responsible for=20 control in the place where the exporter has their seat or where their = goods are=20 packed or loaded for export. In the case of shipments whose value does = not=20 exceed 3,000 euros, the customs declaration may be submitted to the = customs=20 office of exit. Goods are considered to be exported if they leave the = EU=92s=20 customs territory in the same state as they were at the moment of = receipt of the=20 export customs declaration.
Once exported, these goods = become=20 non-community goods. In special cases, for the exporting of goods the = submission=20 of a customs declaration is not necessary. =
Non-community goods may be = re-exported from=20 the EU=92s customs territory, destroyed under customs control or given = up to the=20 benefit of the state if such an option is envisaged in the national = legislation=20 of the EU member state in question. Except for special cases, the = customs bodies=20 must be previously informed about the re-exportation, destruction or = cession of=20 goods.
In the case of re-exportation, = the=20 formalities envisaged for the export of goods, including trade policy = measures,=20 are applied. The customs bodies may prohibit re-exportation if it is so=20 envisaged by the relevant formalities or measures. If goods released for = the=20 customs procedure with an economic impact while they are kept in the = EU=92s=20 customs territory are intended for re-exportation, a customs declaration = needs=20 to be submitted.
Destruction under customs = control is=20 conducted in accordance with national regulations. It is important that = in the=20 process of destruction a debt is not incurred for the customs service. = Such=20 goods should not incur any costs for the state.
The abandonment=20
of goods to the Exchequer to the customs authority for its free =
disposal=20
is done in accordance with national regulations. The
Free zones and free warehouses = are parts of=20 the EU=92s customs territory or a space in an area separated from the = rest of the=20 territory. In the free zones or free warehouses non-community goods is = stored as=20 if it has not been placed in the EU=92s customs territory. For = community-goods,=20 the measures to be applied are those that are as a rule applied to the = exporting=20 of goods.
The purpose of free zones is to = conduct=20 customs control when goods are brought into the free customs zone. In = the free=20 customs zone these goods are used freely without any payment of duties. = When=20 goods are taken from the free customs zone the customs control is = conducted=20 again. If goods in the free customs zone are released for free = circulation or=20 imported temporarily, import duties shall be paid.
The time frame for keeping goods = in the free=20 customs zone or in the free warehouses is not limited. For some goods = subject to=20 the common agricultural policy, a special time frame may be = imposed.
Under the conditions set by the = customs=20 regulations, it is permitted to conduct all types of industrial, trade = or=20 service activity in the free zones or free warehouses. These activities = may be=20 conducted upon the prior notification of customs bodies. Community-goods = that is=20 subject to the common agricultural policy may only be subject to = procedures that=20 are explicitly envisaged for that type of good.
For free warehouses the same = rules of=20 procedure apply as for free zones. Free warehouses differ from free = zones in=20 that free warehouses are indoor premises, while free zones may include = one or=20 more indoor and outdoor premises.
